7. Licensing conditions
To obtain the type approval of radio transmission equipment, the following conditions shall be met:
(1) The applicant has the corresponding production capacity, technical strength and quality assurance system;
(2) The working frequency, power and other technical indicators of radio transmission equipment shall comply with the national standards and the relevant provisions of the State radio administration.
8. Prohibitive requirements
Those that do not comply with the provisions of paragraph 7 of these Guidelines will not be granted permission.
Application materials and test sample requirements
(1) Application Form for Type Approval of Radio Transmitting Equipment;
(b) "Radio transmission equipment type Approval commitment";
(3) A copy of the applicant's business license or the legal person certificate of the institution (affixed with the applicant's signature), and the overseas applicant shall provide legal organizational certification materials (affixed with the applicant's signature);
(4) The specific agent shall submit the agent's power of attorney signed by the applicant and the agent's valid identity certificate, and the agent and the entrusted agent in the application form shall be consistent;
(5) Production capacity, technical strength, quality management system and other materials related to the production of radio transmission equipment.
The domestic applicant who has obtained the quality management system certificate can fill in the certificate number in the application form; Other circumstances and have not yet obtained the quality management system certificate, submit a detailed introduction of the technical capacity, production capacity and quality assurance system stamped with the official seal of the applicant.
The production capacity certificate should at least include the main production equipment model, the number of sets or production lines, the production plan, the corresponding testing equipment (facilities), etc.
Where the applicant entrusts a foundry to produce, it shall provide the entrustment contract between the applicant and the foundry, as well as the entrusted party's technical capacity, production capacity and quality assurance system and other materials.
If the applicant voluntarily submits the mandatory certification, recommended certification or voluntary certification provided by the State, and can prove after examination that it has the corresponding technical capability, production capacity and quality system, the application materials required by this article may be simplified.
(6) Equipment instruction manual, technical manual, circuit diagram, circuit block diagram or schematic diagram related to wireless transceiver function, key RF components (such as RF signal processing chips, power gain related devices, filters, baseband chips, RF transceiver related devices, RF power supply and other management related devices, switching devices, diplexers, antenna related devices, clock related devices, etc.) The list. The specification shall specify the display mode of the type approval code;
(7) The use of electronic form to display the model approval code, should provide a display to view the model approval code description and electronic sign style, and comply with the "Ministry of Industry and Information Technology on the electronic display of radio transmission equipment model approval code Notice" (Ministry of Industry and Information Technology No. 211 (2015)) of the relevant provisions;
(8) a set of color photos of the equipment, including the appearance, internal circuit board and sign photos, sign information should include the manufacturer, product model, model approval code identification style, etc., the photo should be marked with scale;
10. Basic procedures
(1) Acceptance procedures
If the application materials are complete and in accordance with the legal form, or the applicant submits all the supplementary materials as required, it shall be accepted, and the Notification of Acceptance of the Approval Matters of Radio transmission Equipment Model Approval (Acceptance Form) shall be issued;
If the application materials are not complete or do not conform to the legal form, the applicant shall be informed of the materials needed to be corrected at the site or within 5 working days; If the application is not accepted, a written certificate bearing the special seal and date of the administrative organ shall be issued.
(2) Review and testing procedures
After the application is accepted, the Ministry of Industry and Information Technology shall entrust the testing institution that undertakes the testing work (hereinafter referred to as the inspection institution, see Annex 5) to test whether the radio transmission equipment meets the relevant regulations and technical standards of the State radio management, and inform the applicant of the time required for the test.
The Ministry of Industry and Information Technology will entrust relevant testing tasks according to the bidding results and the independent choice of the applicant. The applicant shall, after receiving the relevant information of the confirmed inspection institution, send the samples conforming to the requirements to the inspection institution by Posting or delivery as soon as possible. If it is inconvenient to send the samples due to the large size of the samples or other reasons, the applicant shall negotiate with the testing institution for on-site testing.
The inspection authority shall complete the entrusted test task within the prescribed time, and submit the test results, which shall be reflected in the form of "Radio transmission Equipment type Approval Test Report".
Test time includes sample delivery, transportation, debugging and actual test time.
(3) Review and decision procedures
From the date of acceptance of the application, the Ministry of Industry and Information Technology shall make a decision on approval or disapproval within 30 working days based on the data review and test results, as well as the on-site inspection and expert review if necessary. If approved, the acceptance center shall issue the type approval certificate to the applicant; If no approval is granted, a notice of disapproval shall be issued and the reasons given. The expert review or technical testing time required for the implementation of the license shall not be calculated within 30 working days.
Note:
1, radio transmission equipment model approval application materials must provide the Chinese version.
2, the applicant should have an independent legal personality.
3, the production or import of radio transmission equipment that should obtain model approval, in addition to complying with laws and regulations such as product quality, national standards and the relevant provisions of the State radio management, should also meet the technical indicators approved by the type approval certificate of radio transmission equipment, and mark the type approval code on the equipment.
Punishment regulations
(1) In accordance with the Regulations of the People's Republic of China on Radio Administration, Article 76 administration provisions, production or import of radio transmission equipment sold and used in the country has not obtained model approval, the radio regulatory authority shall order correction, and impose a fine of not less than 50,000 yuan but not more than 200,000 yuan; If the party refuses to make corrections, the radio transmitting equipment without model approval shall be confiscated and a fine of not less than 200,000 yuan but not more than 1 million yuan shall be imposed. Article 78 Where a person sells a radio transmission equipment which, according to the provisions of Article 44 of these Regulations, should obtain type approval but does not obtain type approval, the radio regulatory authority shall order it to make corrections, confiscate the illegally sold radio transmission equipment and the illegal income, and may concurrently impose a fine of less than 10% of the value of the illegally sold equipment; Those who refuse to make corrections shall concurrently be fined not less than 10% but not more than 30% of the value of the equipment illegally sold.
